Welcome to SabaiBrain. These Terms of Use (“Terms”) are an agreement between you and SAMONGDEE SABAIBRAIN Co., Ltd. (บริษัท สมองดี สบายเบรน จำกัด) (the “Company”) and govern your use of the SabaiBrain application, website, content and related services (together, the “Service”). By registering for, accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and the Company’s Privacy Policy. If you do not agree, please do not use the Service.

1. Definitions

  • User means any person who registers for or uses the Service.
  • Primary User means a User who uses the Service to train their own brain and track their own well-being.
  • Caregiver means a family member, relative or carer whom a Primary User has authorized to link accounts in order to view the Primary User’s activity or receive alerts.
  • Content means brain-training games, quizzes, assessments, videos, articles, text, images, audio and any other material in the Service.

2. The Service

SabaiBrain provides brain-training activities and games, basic self-assessments, educational content on life changes, health care, retirement planning and dementia, activity tracking, and caregiver alerts. The Company may add, change or discontinue any feature as appropriate to improve the Service.

3. Medical Disclaimer (Please Read)

  • The Service is intended to support well-being and provide general information only. It does not provide medical diagnosis, treatment or medical advice, and it is not a substitute for consultation with a doctor or other health professional.
  • Scores, assessment results and recommendations in the Service are indicative only. If you or someone close to you has concerns about memory or health, please consult a doctor.
  • The Service is not an emergency monitoring system. In a medical emergency, call 1669 (Thailand) or contact the nearest hospital immediately.

4. Registration and Accounts

  • You must be at least 18 years old and have legal capacity to enter into a contract. Where a Primary User cannot register or give consent personally, a parent, guardian, curator or other legal representative may act on their behalf as permitted by law.
  • You agree to provide accurate, current and complete information and to keep it up to date.
  • You are responsible for keeping your account and login credentials secure and for all activity under your account. Please notify the Company immediately of any unauthorized use.

5. Caregiver Accounts and Family Linking

  • A Caregiver account may be linked to a Primary User only with the consent of the Primary User (or their legal representative). The Primary User may choose what information is shared and may unlink at any time.
  • Caregivers agree to use a Primary User’s information solely for care purposes and not to disclose, share or use it in any way that harms the Primary User.
  • Alerts may be delayed, inaccurate or not delivered due to internet connectivity, devices, settings or other factors beyond the Company’s control. Caregivers should not rely on the Service as their only means of looking after a Primary User.
  • Caregivers are responsible for any decisions or actions they take based on information in the Service.

6. Fees

The Service is currently provided free of charge. If the Company introduces paid services or features in the future, it will inform you of the details, prices and conditions in advance and will not charge you without your agreement. You are responsible for any internet or mobile data charges incurred in using the Service.

7. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose or in a manner contrary to public order or good morals;
  • create an account using another person’s information, or access, link to or track another person’s data without their consent;
  • copy, modify, distribute, sell or commercially exploit any Content without prior written permission;
  • reverse engineer, interfere with, probe for vulnerabilities in, or disrupt the Service; or
  • use bots, scrapers or other automated means to access or collect data from the Service.

8. Intellectual Property

All Content, games, videos, software, designs, names, trademarks and logos of SabaiBrain (สบายเบรน) are the intellectual property of the Company or its licensors. The Company grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes for as long as you comply with these Terms.

If you submit feedback or suggestions about the Service, you agree that the Company may use them to improve and develop the Service without compensation to you.

9. Personal Data

The Company collects, uses and discloses your personal data, including health data, which is sensitive personal data, in accordance with its Privacy Policy and Thailand’s Personal Data Protection Act B.E. 2562 (2019). The Company processes health data only with your explicit consent, and you may withdraw consent through the channels described in the Privacy Policy.

10. Service Availability

The Service is provided “as is” and “as available.” The Company will make reasonable efforts to keep the Service running continuously and securely but does not guarantee that it will be uninterrupted, error-free or suitable for every specific need. The Company may temporarily suspend the Service for maintenance or upgrades.

11. Limitation of Liability

To the extent permitted by law, the Company shall not be liable for any indirect, special or consequential damages arising from the use of or inability to use the Service, reliance on information or assessment results in the Service, or delayed or undelivered alerts. This limitation does not apply to damage caused by the Company’s willful misconduct or gross negligence, or to any other case in which liability cannot be limited by law.

12. Suspension and Termination

  • You may stop using the Service and request deletion of your account at any time via the in-app menu (where available) or by contacting hello@sabaibrain.com.
  • The Company may suspend or terminate your account if you breach these Terms, provide false information, or use the Service in a way that may harm the Company or other Users.
  • Upon termination, your personal data will be handled in accordance with the Privacy Policy.

13. Third-Party Services

The Service may connect or link to third-party services such as the App Store, Google Play, LINE or video platforms. Your use of those services is governed by their own terms and policies. The Company does not control and is not responsible for third-party services.

14. Changes to These Terms

The Company may update these Terms from time to time. It will notify you through the application or its website and display an “Updated” notice for 30 (thirty) days. For material changes, the Company may ask you to accept the new Terms. Continuing to use the Service after the updated Terms take effect means you accept them.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, and any dispute relating to them shall be subject to the jurisdiction of the Thai courts. If there is any inconsistency between the Thai and English versions, the Thai version shall prevail. If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full effect.
